Cost Over-runs Because of Failure to Secure Access to Source Code

Via Computerworld, a story about how cost over-runs at the Boston big dig contruction project arose because of a failure to secure access to source code.

It sounds as though once the project came to phase #2, the developer of the software refused to deliver source code, and the resulting delays pushed the project considerably over budget.  Unfortunately, the story does not clearly explain how the project got going without anyone ensuring that the development agreement specified ownership and access to source code.
