Social (Media) Host Liability – BC Libel Lawsuit

In one of the first cases of its kind in Canada, and what could be the first case to go the distance (based at least on the deep pockets of one defendant), Google, Wikipedia and Openpolitics.ca are being sued in BC for libel based on user-generated content. Michael Pilling, the operator of openpolitics, was involved in a panel discussion on internet libel I chaired last year for the benefit of Jon Newton, who was and still is the defendant in a similar case.I haven’t seen the claim yet, but the Globe has some detail, though its little more than the usual heavy breathing by a plaintiff. Mike has his usual fresh perspective: “Google, Wikipedia Sued By Politician Confused About How The Internet Works”:The guy is quoted as saying: “I’m determined that the people who have acted so irresponsibly will find that there are consequences.”… The end result, of course, is that he’s only going to get a lot more attention drawn to the fact that a lot of people don’t think very highly of him and expressed that opinion in online forums.

“Sliming Wolfowitz”

Hitchens’ essay on Paul Wolfowitz is mandatory reading – and just about the only intelligent piece I’ve read so far – on the Wolfowitz-RIza matter. I can’t help but suspect that this episode has been inflated by Bank employees annoyed at him for trying to shake things up at the Bank, and member countries annoyed at him for pursuing corruption as vigorously as he has.

BCE: No “Ongoing” Private Equity Discussions? No “Current” Private Equity intention?

One just had to laugh at Sabia’s denial of private equity discussions a few weeks ago after the Globe initially reported the story – the denial was so carefully parsed and over-lawyered that if anything it served to prove the story, not deny it (except perhaps to Eric Reguly, who mysteriously said after the denial that Sabia had “made his message clear”, and to Tavia Grant and Andrew Willis of the Globe, who today called the development “a stunning twist”). The Globe today reported that BCE has confirmed the talks. Finally, the waiting is (nearly) over. This development has been self-evident since BCE announced its now defunct income trust plans – a clear sign at the time, to my mind, that BCE management had surrendered to the future, and was ready to pack up and go home.

Any Publicity is Good Publicity

One of the things I love about Mike Masnick’s writing at Techdirt is that he always has a unique perspective on the events that everyone else comments on. The recent news about research into the phenomenon of popularity begetting popularity is a great example. While the topic was widely written about in the ‘sphere with mostly mundane observations, Mike notes one fascinating interpretation: “this actually supports the idea that giving away content for promotional purposes is a very important strategy in developing a brand”. Oh – and yes, Mike is coming to mesh.

Net Neutrality and Traffic Shaping in Canada
