Surprise Employment Standards Inspections

Michael Fitzgibbon reports that the Ontario Ministry of Labour has announced that in the next year it will conduct “2,500 surprise proactive workplace inspections” to look for contraventions of the Employment Standards Act (press release here).

Note that “information technology professionals” are not covered by several provisions of the ESA. The Act defines this occupation as “an employee who is primarily engaged in the investigation, analysis, design, development, implementation, operation or management of information systems based on computer and related technologies through the objective application of specialized knowledge and professional judgment”. The exceptions are explained here. Details on Ontario employment standards legislation generally is at the Ministry’s website.
