US District Court Judge Dale A. Kimball, who is presiding over a lawsuit brought by SCO Group accusing IBM of copyright infringement – SCO is seeking at least $5 billion from IBM, accusing the company of illegally inserting its proprietary Unix code into Linux – issued an interim order today dismissing a motion by IBM for summary judgment, but in the course of issuing that order had some strong words for the apparent weakness of SCO’s case.
